May 19, 2026Following a series of Instagram posts, our client a well-respected social media influencer received threats of injunctive action relating to alleged defamatory content published online.
The opposing party demanded that our client remove the alleged defamatory material within 48 hours and provide a number of undertakings concerning future publications, together with payment of costs.
WYN Legal was instructed and, within hours, sent a robust response setting out that the opposing party had failed to:
- Properly comply with the Pre-Action Protocol for Media and Communications Claims;
- Properly identify or apply the legal test for defamation under the common law and section 1 of the Defamation Act 2013; and
- Avoid conduct which risked amounting to a Strategic Lawsuit Against Public Participation (“SLAPP”).
Despite initially adopting an aggressive approach, the opposing party quickly retreated and took no further action against our client.
As a result, our client retained all of their social media content across their channels.
